1. Introduction

Welcome to Eugene Ivanov Gallery, the official online gallery of artist Eugene Ivanov, available at eugeneivanov.art.

These Terms of Service govern purchases made through our online store and the use of our website. By placing an order, you agree to these Terms, subject to your rights under applicable consumer protection laws.

3. Original Artworks

All paintings offered through Eugene Ivanov Gallery are original artworks created by the artist, unless expressly stated otherwise.

Each original painting is a unique physical object. Minor differences between its appearance in photographs and in person may arise from lighting, screen settings and photographic reproduction.

Artwork descriptions, dimensions, materials, techniques, prices and availability are provided on the relevant product pages.

We make every reasonable effort to ensure that this information is accurate and up to date.

4. Orders & Contract Formation

By placing an order through our website, you submit an offer to purchase the selected artwork at the price displayed at checkout.

A purchase contract is concluded when Eugene Ivanov Gallery accepts your order by sending an order confirmation email.

Because original artworks are unique, availability is limited to one original of each painting unless otherwise indicated.

If an artwork becomes unavailable due to an inventory error or another exceptional circumstance, we will contact you promptly and arrange a refund of any payment received if the order cannot be fulfilled.

We reserve the right to decline an order for legitimate reasons, including suspected fraud or inability to deliver, subject to applicable law.

5. Prices & Payments

Prices are displayed in the currency applicable to your selected market and are confirmed before you complete your purchase.

The seller is established in the Czech Republic and is not registered as a Czech VAT payer (neplátce DPH). Czech VAT is therefore not charged by the seller under its current tax status.

Payments are processed through the payment methods offered at checkout.

Any currency conversion charges or fees applied independently by your bank or payment provider are outside our control.

The total amount payable to the gallery is displayed before the order is submitted. Any applicable import duties or taxes payable separately upon import are described below.

6. Complimentary Shipping & Delivery

We offer complimentary worldwide shipping, courtesy of the artist, to destinations supported by our checkout.

Orders are prepared for dispatch within 2 business days, excluding weekends and public holidays.

Estimated carrier transit times are:

• Europe: 1–7 business days

• Rest of the World: 3–20 business days

Including the stated processing time, the corresponding estimated total delivery windows are 3–9 business days for Europe and 5–22 business days for the Rest of the World.

Delivery estimates are not guarantees. Actual delivery may be affected by carrier operations, customs clearance, destination restrictions, holidays and other circumstances.

The gallery remains responsible for the shipment until the risk legally passes to the customer under applicable law.

7. Import Duties & Taxes

Customers are responsible for any applicable import duties, import taxes, customs clearance charges and carrier handling fees imposed in the destination country.

These charges are not included in the artwork price and are not collected by Eugene Ivanov Gallery at checkout.

Any such charges are determined by the relevant authorities or carriers and may become payable before or upon delivery.

Customers should review their local import requirements before ordering.

This does not affect any statutory rights or obligations that cannot legally be transferred to the customer.

8. Returns, Withdrawals & Refunds

Customers entitled to statutory withdrawal rights under applicable consumer law may exercise those rights within the relevant withdrawal period.

Our Shopify return settings provide a 14-day return window, measured from delivery of the final item in the order.

For ordinary change-of-mind returns, customers bear the direct cost of return shipping, where permitted by law. We do not charge restocking fees.

Our Return and Refund Policy explains the withdrawal procedure, return arrangements, reimbursement deadlines and model withdrawal form.

Nothing in these Terms limits statutory consumer rights.

9. Cancellations & Order Changes

Orders may be cancelled through the available Shopify cancellation process until fulfillment, subject to applicable conditions.

Please contact us as soon as possible if you need to request an order modification, address correction or cancellation.

Once an artwork has been dispatched, changes to its delivery arrangements may no longer be possible.

Statutory withdrawal rights remain unaffected.

10. Damaged or Defective Artworks

We take great care in inspecting and packaging original paintings.

If your artwork arrives damaged, defective or does not correspond to its description, please contact us at theeugeneivanovmail@gmail.com.

We will address complaints and provide appropriate remedies in accordance with applicable consumer protection law.

For qualifying consumer purchases, statutory rights concerning defective goods apply independently of the return rules described above.

11. Copyright & Intellectual Property

All artworks, photographs, images, text and other original creative materials published on this website are protected by applicable intellectual property laws.

Copyright in artworks created by Eugene Ivanov remains with the artist or relevant rights holder unless expressly transferred through a separate written agreement.

Purchasing an original painting transfers ownership of the physical artwork, not the copyright or reproduction rights associated with it.

Images and other website content may not be reproduced, commercially distributed, licensed or used for commercial purposes without appropriate permission, except where permitted by law.

12. Website Use

You agree to use this website lawfully and not to interfere with its operation, security or accessibility.

We make reasonable efforts to maintain the accuracy and availability of the website, but cannot guarantee uninterrupted access.

We may update website content and product information when necessary. Changes will not retroactively alter concluded purchase contracts without a lawful basis.

13. Privacy & Personal Data

Personal information collected through the gallery is handled in accordance with our published Privacy Policy and applicable data protection legislation.

Our online store operates on Shopify, which provides the underlying e-commerce infrastructure.

14. Applicable Law & Consumer Disputes

These Terms are governed by the laws of the Czech Republic, without depriving consumers of mandatory protections applicable to them under relevant law, including protections applicable in their country of habitual residence where required.

We encourage customers to contact us directly to resolve any concerns.

For completed purchases, the terms applicable at the time of contract formation remain relevant, subject to mandatory law and any changes lawfully agreed between the parties.
